2.On receiving the Notarial certificates/ required documents issued on the behalf of the first party, the second party will sign the Agreement and forward the document for Government process in Nepal.
3.The second party agrees to mobilize the required manpower once it gets all the necessary documents from the first party. Then it forwards the required documents (Bio-Data of the prospective candidates, their Experience certificates, etc) to the first party.The first party will provide visas for the workers and will take guarantee for the fulfillment of te conditions(i.e. salary, accommodation and other benefits as per the Demand Letter agreed upon.
4.In case of non issuance of visas, due to any changes in the Government policies, rules and regulations of their countries, the first shall be responsible for the recruitment expenses
5.The second party should make sure that all workers recommended for the first party are examined by the G.C.C. Nepalese doctors, in the case of Saudi Arabia, the candidates must posses a validity of visa of the country concerned.
6.The first party will be responsible for receiving the workers with valid visas at the airport.The first party will have to receive as many workers as the second party sends.
7.The Second Party is the supplier of the workers and will bear the responsibilities for the recruitment of the workers from Nepal exactly as per the agreement between the two parties involved or, it may invite the first party or its authorized Representative for recruitment of the workers within the stipulated period and not exceeding 45 days from the receipt of visas and other required documents.
8.The First Party agrees to bear the compensation in case of death or injury of the workers and also agrees to bear the cost of the transportation of the deceased body to Nepal as per the labor law of country concerned.
9.There will be a probationary period of 3 months for all the workers. If any worker is found unfit or unsuitable for the job given after the completion of this period, the worker may be sacked and repatriated at his own cost.
10.The worker will be interviewed, tested by the Representative of the employer.
11.The Second party shall assist the workers in matters relating to the immigration formalities, medical tests and visa stamping from the embassy concerned and whatever other relevant matters.
12.The First Party ensures to provide the workers with free bachelor sharing accommodation, and other necessary amenities, including medical and insurance coverage also, provide free food as agreed upon.
13.The First Party agrees to inform the Second Party about its changed requirement through any means of communication specifying personnel requirements, their respective job description, salaries other terms and conditions, and the desired mobilization of the prospective workers within the time frame fixed.
14.The Second Party shall be responsible if it fails to fulfill the demand of qualified candidates required. The Second Party notifies the First Party about such short listed qualified candidates who are ready for final interview and selection. The First Party has the right either to send his representative or give the authority to the Second Party the right to do the selection process and send such qualified workers on the Second Party’s full Guarantee.
15.All the expenses for recruitment process will be borne by the Second Party.The First Party has to pay for the Air Ticket expenses for the repatriation of the workers after their completion of the original contract period.
